Virginia Workers’ Compensation: Claims, Disputes, and Help
On This Page
Which System Handles This Claim?
Virginia expressly warns that notifying the employer is not the same as filing a claim with the commission. Even when an employer or carrier voluntarily pays wages or medical bills, the worker must consider the separate filing needed to protect claim rights.
How Do I Report the Injury?
Report the injury or occupational disease promptly. Keep the notice and record when the injury occurred or when a work-related disease was communicated to you. The commission explains different timing rules for accidents and occupational disease.
What Do I File?
File the commission’s Claim Form using its current instructions. Once a claim is established, a Jurisdiction Claim Number and PIN provide access to WebFile. Maintain your address with the commission so notices reach you.
What if Benefits Are Disputed?
If the employer or carrier refuses benefits, the worker can send a written hearing request to the commission. The hearing requires evidence connecting the injury or disease and claimed disability to work; the insurer’s refusal is not the commission’s final ruling.
Where Can I Get Help, and What Should I Bring?
Bring the Claim Form, payment history, medical reports, and any light-duty work information. Virginia’s page also distinguishes accidental injuries from gradually developing conditions and recognized occupational diseases. Ask about that classification when symptoms developed over time, rather than assuming every repetitive condition is handled in the same way.
