Which System Handles This Claim?

New Mexico’s Workers’ Compensation Administration provides claim information and mediation. Its Ombudsman Bureau gives neutral information and assists self-represented workers with forms, but cannot assist a represented party or a claim already in formal adjudication.

How Do I Report the Injury?

Give the employer or supervisor notice of the work accident. The WCA explains its standard Notice of Accident form and exceptions involving an employer’s actual knowledge. Keep a copy rather than relying only on an informal conversation.

What Do I File?

The employer and insurer initially decide whether to accept the claim. Provider selection also has specific rules: the WCA describes how the party that did not make the initial selection may later change providers. Ask about the correct notice before arranging a change.

What if Benefits Are Disputed?

An unresolved benefits dispute may enter the WCA’s complaint and mediation process. A worker does not have to retain an attorney merely to attend mediation, but may seek advice about disputed causation, disability, or settlement terms.

Where Can I Get Help, and What Should I Bring?

Before contacting an ombudsman, identify whether you need help with notice, the insurer’s decision, a provider change, or a complaint already filed. Bring the accident notice and any insurer or WCA correspondence. Check current forms through WCA; a medical-payment form intended for a provider is not automatically the correct employee benefits complaint.
