Which System Handles This Claim?

Montana’s First Report of Injury serves different participants in sequence: the worker reports to the employer, the employer reports to the insurer or adjuster, and the insurer sends claim data to the department. Keep track of which step has actually happened.

Official Montana Guidance.

How Do I Report the Injury?

Report the injury or occupational disease and complete the applicable portions of the FROI. The division supplies online and printable versions and instructions. Keep the signed form and confirmation, and ask for the adjuster handling the claim.

What Do I File?

The claim-assistance forms page also contains settlement and advance forms. Those are not substitutes for the initial report. Do not select a settlement form merely because a carrier has offered a payment; understand what issues and future benefits the document addresses.

Official Montana Guidance.

What if Benefits Are Disputed?

The department’s claimant mediation guide describes telephone conferences with a neutral mediator. If no agreement is reached, the mediator issues a recommendation, after which an unresolved dispute may proceed to the Workers’ Compensation Court as applicable.

Where Can I Get Help, and What Should I Bring?

Before mediation, write down the disputed benefits and gather the documents supporting your position. The guide asks parties to send supporting material in advance of the conference. Keep the recommendation and response instructions; mediation participation and a later court filing involve separate procedural obligations.
