Which System Handles This Claim?

New Hampshire’s Department of Labor administers workers’ compensation and hearings on contested claims. Its official administrative rules identify separate employee notice, employer reporting, payment, and denial documents. The state-employee program has additional internal procedures that should not be applied to all private workers.

How Do I Report the Injury?

Report the work-connected injury or illness to your employer and ask for Notice of Accidental Injury or Occupational Disease, Form 8aWCA. Lab 504.02 directs employers to give the employee an acknowledged copy of this notice.

What Do I File?

The employer’s First Report of Injury, Form 8WC, goes to the department and carrier under the rules. Keep your employee notice separately from that report. The fact that the employer filed a report does not mean it accepted responsibility for benefits.

What if Benefits Are Disputed?

Lab 506.02 addresses payment and denial notices, including the Memo of Denial of Workers Compensation Benefits. A denial can be challenged through the department’s hearing process. Read the stated grounds and obtain current hearing-request instructions from the division.

Where Can I Get Help, and What Should I Bring?

Use the Department of Labor’s current forms collection and ask the Workers’ Compensation Claims Department about the appropriate filing route. Keep employee notice, employer reporting, and denial documents separately. Verify the current submission method and retain proof of sending; calling about a disagreement does not itself document a hearing request.
