Iowa Workers’ Compensation: Claims, Disputes, and Help
On This Page
Which System Handles This Claim?
Iowa’s DIAL explicitly says initial workers’ compensation claims are handled by the employer, insurer, or third-party administrator, not filed with the division. DIAL serves as a neutral decision-maker for contested cases and cannot give a party legal advice.
How Do I Report the Injury?
Notify the employer as soon as possible about the work injury or condition. Keep the notice and ask which insurer or administrator is investigating it. If the claim is denied, request the reasons rather than treating silence as a completed decision.
What Do I File?
A contested case begins by filing a petition with DIAL and serving the employer and, when applicable, the insurance carrier. The division requires electronic filing through the Workers’ Compensation Electronic System for contested cases.
What if Benefits Are Disputed?
After pleadings, the parties request an arbitration hearing through WCES. A deputy commissioner hears the evidence and issues a decision. Rehearing, commissioner review, and judicial review are later procedures with their own requirements.
Where Can I Get Help, and What Should I Bring?
Identify whether your problem is still with the initial insurer investigation or has become a contested case. Gather the notice to the employer, denial, medical evidence, and wage records. Keep service records as well as the electronic filing receipt; sending a petition to the agency does not replace the requirement to serve the other parties.
