Court Issues Ruling in NOSSCR Lawsuit Case – Motion to Dismiss Filed

Washington, D.C. – February 27, 2025 – A significant legal development has unfolded in the ongoing dispute between the National Organization of Social Security Claimants’ Representatives (NOSSCR) and plaintiffs Natalie J. Keeve and Michael Liner. In a motion filed yesterday in the Superior Court of the District of Columbia (Case No. 2025-CAB-000647), the Defendants, NOSSCR and Board President Paul Burkhalter, have moved to dismiss the complaint brought against them. The motion argues that the case is now moot and lacks standing, as the plaintiffs have been reinstated to the board and provided access to corporate records as requested.

Key Developments in the NOSSCR Lawsuit Case:

  • Temporary Restraining Order Issued: On February 6, 2025, the court granted a TRO preventing NOSSCR from removing Keeve and Liner from their board positions pending further proceedings.
  • Defendants’ Motion to Dismiss: Filed on February 25, 2025, the motion contends that:
    • Keeve and Liner have been fully reinstated as NOSSCR board members.
    • All requested corporate records have been offered subject to a protective order.
    • The removal proceedings against the plaintiffs have been withdrawn.
  • Allegations of Financial Misconduct: NOSSCR argues that the financial misconduct claims raised by the plaintiffs are baseless and had already been reviewed by an independent governance committee, which found no evidence of wrongdoing.

Legal Implications

NOSSCR’s legal team asserts that the plaintiffs’ lawsuit should be dismissed under Rule 12(b)(1) for lack of subject matter jurisdiction due to the case being moot. They also argue that Board President Paul Burkhalter is shielded from liability under D.C. Code § 29–406.90, which provides immunity for nonprofit board volunteers.

Next Steps

The court has scheduled a hearing for April 4, 2025, where both parties will present their arguments regarding the motion to dismiss. If the motion is granted, the case will be formally closed.

Statement from NOSSCR

NOSSCR remains committed to its mission of advocating for Social Security Disability claimants and ensuring the integrity of its leadership. We look forward to resolving this matter in a manner that allows us to continue serving our members and the broader disability advocacy community.
