For lung cancer, the exact pathology and extent of disease can make a substantial difference to SSA's evaluation. The application should also describe breathing limits, treatment effects and other conditions that affect functioning. A general statement that you have lung cancer may leave out the details needed for a timely and accurate medical review.

How SSA Evaluates This Condition

Listing 13.14 distinguishes small-cell carcinoma from non-small-cell carcinoma with specified inoperability, unresectability, recurrence or spread. It also contains a separate provision for certain superior-sulcus tumors treated with multimodal anticancer therapy. The precise records matter; a broad stage label should not be used as a substitute for the applicable criteria. If a listing is not met or equaled, SSA can evaluate residual functional capacity, including the effects of respiratory disease and treatment.

Records That Can Clarify Your Claim

  • Pathology, imaging and oncology reports identifying the cancer type, sites of disease and whether it has recurred or spread.
  • Records explaining surgery decisions, treatment plans, treatment dates, response and complications; include relevant operative and hospital reports.
  • Documentation of breathing, endurance and other functional limitations, with relevant pulmonary testing and records of prescribed support when applicable.

Explain the Effect on Daily Activities and Work

Explain how far you can walk, what happens with stairs or carrying and how much recovery you need. Describe the effects of pain, fatigue or treatment-related symptoms on attendance and pace when those occur. If you use oxygen, identify the prescribed circumstances and practical needs without assuming equipment use alone resolves the claim. Include coexisting lung or heart disease and describe the combined limitations, not only the cancer treatment schedule.

Treatment and Its Effects

NCI describes different treatment approaches for non-small-cell and small-cell lung cancer. Depending on the situation, care can involve surgery, radiation, chemotherapy, targeted therapy or immunotherapy. Treatment is individualized and may combine approaches. Preserve the actual plan, changes in that plan and follow-up findings. Side effects vary among people, and an improvement on imaging may not immediately explain stamina or daily function. Your oncology team should direct treatment; the application should accurately record what happens.

If care is delayed or interrupted, document the reason, such as cost, lack of access, side effects or medical advice, and your efforts to obtain appropriate care. SSA has specific rules for prescribed treatment and good cause; a treatment gap should not be left unexplained.

Preparing an Application or Appeal

List the facilities holding pathology and treatment records, including care received outside your usual clinic. Explain the physical and schedule demands of prior work and what changed as the illness progressed or treatment began. If denied, check whether the record correctly identified the cancer type and extent of disease. Also review whether ongoing limitations, duration and other eligibility requirements were addressed, and follow the notice's appeal instructions.

This guide concerns adults. Disability generally must prevent substantial gainful activity for at least 12 consecutive months, be expected to do so, or be expected to result in death. SSDI also has insured-work requirements; SSI has financial and other eligibility rules. Childhood claims use a different medical framework.

What Approval Rates Can Tell You

The sources reviewed do not establish a current personal approval probability for lung cancer. Survival rates, treatment response rates and disability allowance rates measure different outcomes. Broad cancer statistics can also combine cases with very different SSA criteria, so they should not be presented as your odds.

See Disability Approval Rates: Years, Diagnoses and Limits for dated SSA figures and an explanation of their denominators.

Is Small-Cell Lung Cancer Evaluated Like Every Other Lung Cancer?

The adult lung-cancer listing has a specific small-cell provision. Make sure the pathology and oncology records clearly identify the diagnosis. A medical listing finding does not eliminate the separate nonmedical requirements for benefits.
